Student Learning Centre: Informed Consent

WAIVER, RELEASE, ASSUMPTION OF RISK

While Toronto Metropolitan University (the “University”) has put in place reasonable measures to reduce the spread of COVID-19, the University cannot guarantee that any individual using the University’s facilities (the “Facilities”) will not become infected with COVID-19.

As part of those safety measures and for the benefit of the broader TMU community including your fellow students, the University is asking students that will be using the Facilities to carefully review, confirm, and agree to the statements made below by checking the corresponding box.

I understand that:
Yes ⌧ COVID-19 is extremely contagious, can spread by person to person contact with droplets produced by person who has the virus and has been declared a worldwide pandemic by the World Health Organization.

Yes ⌧ The Province of Ontario has announced additional measures as part of its COVID-19 Response Framework under which they are requiring individuals living in Toronto to restrict trips outside of the home for essential reasons only, and to limit contact with individuals outside of your household

Yes ⌧ By visiting the Facilities I could become infected with COVID-19, which could result in:
● extended quarantine/self-isolation, hospitalization that may require medical therapy/intervention or intensive care treatment, death, and other additional risks, some of which may not currently be known at this time. These risks could cause me to incur medical and other expenses. Certain individuals with underlying conditions are at higher risk of contracting COVID-19 and experiencing significant personal injury or death.

Yes ⌧ I certify that:
● My use of the Facilities is essential and critical to my being able to successfully meet the mandatory requirements of my class and to enable me to achieve the class’s learning
objectives without the risk of compromising academic integrity.

● I have informed myself of the risks of COVID-19. I knowingly, and willingly consent to visit
the Facilities even though my use of the Facilities and interaction with others could heighten the chances that I become infected with or spread COVID-19.

● I will abide by all policies, procedures, protocols, standards and instructions for health and safety that the University may impose related to the Facilities to promote public health and
safety. I understand and agree that failure to do so may result in my removal from the Facilities.

● I will cancel my booking and will not use the Facilities if my answers to any of the above statements change prior to me using the Facilities,

In consideration of the University permitting me to use the Facilities I agree:
● To release the University, its members, officers, employees, students, agents, volunteers and independent contractors (the “Releasees”) from any and all liability for any loss, damage, injury, illness, death or expense that I may, or that members of my household(s) may suffer, including the contraction of COVID-19, as a result of my use of the Facilities, including such loss, damage, injury, illness, death or expense that is caused by the negligence, breach of contract, or breach of any statutory or other duty of care (including any duty owed under the Occupier’s Liability Act, RSO 1990 c O.2, as amended).

● To hold harmless and indemnify the Releasees from any and all liability, causes of action, claims, judgments, costs and expenses (including legal fees) that I, a member of my
household(s), or any third party may suffer as a result of my use of the Facilities, including due to any act, omission, or negligence of the Releasees.

● I have carefully read, fully understand, and freely and voluntarily accept the terms contained within this Agreement and understand that I, on my own behalf, am giving up
substantial rights and accepting the risk that I may come into contact with, be exposed to, or be diagnosed with COVID-19 following my use of the Facilities.

● I confirm that I have authority to enter into this Agreement and understand that the terms contained herein are legally binding. I understand and agree that the assumption of risk
contemplated herein is intended to be as broad and inclusive as possible by the applicable laws of Canada and that if any portion hereof is held invalid, that the balance shall, notwithstanding, continue in full legal force and effect.
